Terms and Conditions

These Terms are a legally binding agreement ("Agreement") between you and ZAPPYRENT (as defined below) which regulates your Access to and use of the ZAPPYRENT website, including all related subdomains and any other websites through which ZAPPYRENT makes its services available (collectively, the "Site"). Our Privacy Policy and Cookie Policy are incorporated into this Agreement by reference.

Introduction

ZAPPYRENT is a company that operates in the real estate market in order to create a space where owners and potential renters can talk, meet and manage their relationship based on transparency and mutual trust. This is possible because the main purpose of our company is to reduce the information and contractual asymmetries between owner and renter through an impartial management of this relationship that aims to ensure a safer market, less expensive for the contractors and supervised at every stage, from the conclusion of the contract until its end, through an accurate assistance. The advantages are countless and immediate, both for the owner and the renter.

1 - General Terms of Service

By using the ZAPPYRENT Site and Services, you agree to comply with and be legally bound by the Terms and Conditions set forth in the following pages, hereinafter referred to as "Terms of Service", whether or not you are a registered user. Therefore, if you do not agree, even partially, with these Terms, you may be subject to certain limitations. At the time of "Registration" (see point 4), you will be explicitly asked to accept the "Terms of Service" in order to be able to use the Services related to the purposes of the Site. This acceptance will be complete and unconditional. The non-compliance with these Terms, consciously accepted, could lead to civil and criminal sanctions, as well as the immediate exclusion of the User from the site. By choosing to register, you acknowledge and agree that your relationship with ZAPPYRENT is limited to being a totally external member, third party and independent from ZAPPYRENT and companies of the same group. Therefore, you shall not qualify as a partner, employee, agent, representative or participant of ZAPPYRENT for any reason whatsoever. You acknowledge and agree that you are acting in your own name and on your own behalf, without ever having received the express or implied endorsement of ZAPPYRENT and without doing anything that could fraudulently mislead others into believing that you are dealing with ZAPPYRENT or related companies. ZAPPYRENT therefore shall not be liable for the conduct of any third party who merely uses the Site, qualifies as or acts on behalf of ZAPPYRENT. They shall be responsible for their own statements in accordance with national law.

2 – Requirements

The use of the Site, registration, and use of the Service is restricted to adults only. By accessing or using the Site you declare and guarantee that you are at least 18 years old. By accepting the "Terms of Service" you also authorize ZAPPYRENT to check the accuracy of personal data provided, tax data, regardless of whether they were provided directly or not, as well as any criminal convictions and other data necessary for ZAPPYRENT to provide its services, to the extent permitted by applicable law. In case the access to specific data is allowed only to the interested party or after delegation of the latter, the user agrees to provide these data before the registration or delegates ZAPPYRENT to collect such data in the name and on behalf of the interested party (e.g. cadastral data, mortgage data, data on previous rentals, income and assets) always in compliance with applicable laws and exclusively for purposes related to the activity of ZAPPYRENT. Such faculty is connected to the purposes of the Service, in order to guarantee a greater protection of the users and third parties as well as of the whole community of ZAPPYRENT.

3 - Contract Terms Changes

ZAPPYRENT reserves the right to modify at any time the "Terms of Service", as well as payment terms and conditions, including changes in tariffs where it is necessary for legal, normative and technical purposes or due to changes in the services provided or in business practices. Notice of such changes will normally be given, except in special cases, and such changes will be binding immediately. These changes will be made known to the User by notification via email or through the Site; it is therefore recommended to regularly read the Conditions available on the platform in order to ensure that you are aware of any changes that may apply. Continued access and use of the Site without cancellation in the thirty days following notification of such changes implies tacit acceptance of the new "Terms of Service". This is without prejudice to your ability to terminate your agreement to use our Site.

4 - Account and Profile

4.1 Account Registration

In order to access the Services offered by ZAPPYRENT, including the creation of ads, you must register on the Site, open an Account and then become a registered User. You will be able to do it in the registration section. You can only have a personal Account. The registration will be done by providing your personal information, which you declare to be true, current and complete. It will be your duty to keep them true, current and complete. At the time of registration you will choose credentials ("Username and / or email" and "Password") that you will need to make the "login" every time you want to access the Site. Your credentials will be protected with advanced technologies in order to prevent theft while leaving the possibility of recovery in case you lose or forget them. In any case, the user is always responsible for the custody of the password agreeing not to communicate it to third parties. ZAPPYRENT reserves the right to suspend or terminate your Account if you create more than one ZAPPYRENT Account or if any information you provide during the registration process or thereafter proves to be inaccurate, untrue, not current or incomplete, or otherwise violates the "Terms of Service". As an integral part of the functionality of the Site, you may choose to (and whether to) link your ZAPPYRENT Account to Third Party Accounts, allowing ZAPPYRENT access to your Third Party Account, to the extent that the Third Party Account Terms and Conditions allow linking to ZAPPYRENT. You represent that you have the right to disclose your Third Party Account login information to ZAPPYRENT and/or to allow ZAPPYRENT access to your Third Party Account, without violating any of the terms and conditions governing the use of the applicable Third Party Account, and without obligating ZAPPYRENT to pay fees, or any other tax liability. Depending on the Third Party Accounts you choose, and subject to the privacy settings you select in such Third Party Accounts, personally identifiable information posted on such Third Party Accounts will be available on and through your ZAPPYRENT Account on the Site, Services and Application. You may disable the connection between your ZAPPYRENT Account and Third Party Accounts at any time by accessing the Site settings or by specifically requesting it from Support.

We inform you that calls could be recorded in order to improve the quality of the service offered.

5 - "Tenant" Terms and Conditions

Tenant is the contractual party of the subject of the Conductor. At the time of registration, accepted the "Terms of Service" are considered accepted also the conditions in the following policy. Please read it carefully. Any changes to these conditions will be communicated according to the procedures in paragraph 3 and are considered tacitly accepted if the user does not delete from the site within 30 days.

5.1 Contract Registration

In order to take advantage of all the benefits offered by ZAPPYRENT it is necessary to register the Rental Contract according to the clauses included in the form provided by ZAPPYRENT. If you have activated an account with ZAPPYRENT Protection, ZAPPYRENT will take care of the registration of the rental contract. In the case of a basic account, it will be the owner to register the rental contract. Failure to register the contract will result in the loss of certain services offered by ZAPPYRENT. Substantial discrepancies will not prevent the Tenant from using our services, however, there may be restrictions. In case of non-registration of the contract or divergent registration, the fees provided by ZAPPYRENT for the use of services subject to payment shall remain due and shall not be subject to refund. Please note that ZAPPYRENT only offers Services to Users registered on the Site and therefore shall never be liable under the law for failure to register the contract on accounts without ZAPPYRENT Protection or for the misleading content and/or omissions of the registrants, nor shall ZAPPYRENT be liable for tax defaults of the parties.

5.2 Service Commission

All accommodations on the portal are uploaded by the Owner, who freely enters the preferred rental rate. ZAPPYRENT reserves the right to charge OWNERS and Tenants fees (and applicable Taxes) for the use of the Platform and provision of the Services. Additional information on when Service Fees apply and how they are calculated is available on our Support and FAQ page. Except as otherwise provided in the ZAPPYRENT Platform, Service Fees are non-refundable. ZAPPYRENT reserves the right to change the Service Fees at any time and will provide Members with notice of all changes before such changes become effective. Changes in Costs will not affect reservations made prior to the relevant effective date. If you do not agree to a change in fees, you may terminate this agreement at any time by emailing customer service specifying account cancellation request for change in fees. Fees include all of the services listed above and are freely available at the Support Center. The same percentage of commissions are also subject to the amounts collected by ZAPPYRENT for utilities and / or incidental expenses.

5.3 Method of Payment

During enrollment and booking, the tenant will be able to choose the payment mode between direct debit to card or bank transfer to pay the first monthly rent plus commission and security deposit.

From the second useful rental payment, the mode of payment of the rent plus monthly expenses is exclusively fixed by bank transfer to the coordinates provided during registration by the ZAPPYRENT platform. The tenant shall make the monthly payments by the 1st of each month, with a maximum tolerance to the 5th of the month. In the event that the Tenant fails to make payment as stipulated, ZAPPYRENT will attempt to charge via any other payment method linked to the user's account. Any cost that ZAPPYRENT incurs in collecting the payment by different payment method, than by bank transfer, will be charged to the client. It is not possible to use any other payment method than those just mentioned, even by agreement of the parties, under penalty of exclusion from the site and loss of all benefits by ZAPPYRENT. The monthly payment paid at check-in refers to the "first full month" that is useful.

If the tenant's check in date is other than day 1 of the month, the next payment (on the 1st of the month after check in) will be equal to a pro-rata share of the monthly payment amount minus the days prior to check in, otherwise the payment due will be of the entire monthly payment.

5.3.1 Penalties for late monthly payment

If the Tenant fails to make payment in the timeframe established in Section 5.3, ZAPPYRENT will charge late penalties which will be collected in the current month's transaction.
The penalties are as follows:

  1. 5 days after payment is due (on the 6th of each month) a penalty of €25 will be charged.
  2. 10 days after the payment due date (the 11th of each month) an additional penalty of €25 will be charged for a total of €50.
  3. 17 days after the payment due date (the 18th of each month) an additional penalty of €25 will be charged for a total of €75.

5.4 Security Deposit

The security deposit paid by the Tenant, the amount of which is decided by the owner of the accommodation, may be retained by ZAPPYRENT, as the sole depositary of such deposit on behalf of the owner, without any exception, in order to ensure greater security to users who rent accommodation on the portal. The deposit will be returned to the tenant at the end of the rental period, with no possibility of early return. The tenant will therefore have to pay the rent until the end of the rental period.

5.4.1 Property Damage

If the owner believes that the tenant has caused damage to the property, it shall be his duty to prove such damage and ZAPPYRENT will take care of the request by estimating the entity of the same, in order to establish the amount of the security deposit that the owner can retain as compensation for the damages suffered. Any decision made by ZAPPYRENT in connection with a claim shall in no way limit the legal rights of each of the parties to the other party to the rental agreement.

In order to recognize the refund described in the previous paragraph, it is the duty of the Owner to provide for the preparation, contextually to the check-in, of a handover report signed by the Tenant and containing a description of the state in which the furniture and the property are at the time of handover. In defect of the delivery report, no refund will be recognized by ZAPPYRENT for any damage discovered at the time of check out.

Zappyrent reserves the right, when available, to use the virtual tour of the apartment at the time of check-out to compare the condition of the property between check-in and check-out, in order to detect any visible damages refundable to the Landlord.

Within 48 hours from the check out, the owner shall have the right to report to ZAPPYRENT and the tenant any differences between what appears on the handover report and the state of the property and furniture at the time of check out. In this case, the Tenant shall restore or pay the cost as agreed with the Owner for any damage to the property or furniture, except for the physiological deterioration related to use.

After 7 days from the request for restoration or compensation made to the Tenant, the Owner may ask ZAPPYRENT to credit a part of the security deposit paid by the tenant as long as the landlord presents ZAPPYRENT with a receipt regarding the sustained costs. If the amount requested by the owner is judged out of market parameters compared to the real cost of repair, ZAPPYRENT may classify this act as an attempt at fraud and reject the request, returning the deposit to the tenant and reserving the right to act in the appropriate forums.

6 - "Owner" Terms and Conditions

By "Owner" we mean the contractual party headed by the subject of the Locator. At the time of registration, accepted the "Terms of Service" are considered accepted also the conditions in the following policy. Please read it carefully. Any changes to these conditions will be communicated according to the procedures in paragraph 3 and are considered tacitly accepted if the User does not delete from the site within 30 days.

6.1 Contract Registration

Please see point 5.1 in full.

6.2 Service exclusivity

By accepting the Terms of Service the User agrees not to place the same ad on other sites at lower prices. Failure to comply with these obligations may result in exclusion from the site and the payment of services for which the beneficiary has benefited free of charge (eg photo shoot). Zappyrent, with the consent of the owner, reserves the right to publish / sponsor the announcement on other selected portals and / or partners in order to maximize the visibility of the same.

6.3 Service fee

Please see paragraph 5.2 in full.

6.4 Methods of payment

At the time of registration or at a later stage (no later than the date of signing the lease) must be associated with your account the IBAN of your bank account, which will be credited, monthly, for the entire duration of the contract, the amounts due. The payment of the rent will be made exclusively by this method. For security reasons imposed by European legislation, may be required in addition to a valid identity document, proof of address and proof of ownership of the account linked to the Iban entered. In the absence of the necessary documents, it will not be possible to transfer the funds to the owner. Please note that only ZAPPYRENT can be the depository of the rent, which can not be paid in cash or with other methods of payment, under penalty of exclusion from the site and loss of all benefits from ZAPPYRENT. If temporarily (and for good cause) the above mentioned payment method cannot be used, exceptionally an alternative payment method could be used but the user has the obligation to communicate it to ZAPPYRENT in advance, under penalty of exclusion from the site and loss of all benefits.

6.5 Bank Account Modifications

In case of closure, deactivation, suspension of the bank account or similar cases that make it impossible to proceed with the transaction, the Renter shall immediately notify ZAPPYRENT in order to change the account to which the rent shall be credited or to provide a temporary (alternative) method of payment.

6.6 Damage to the property

If the owner believes that the tenant has caused damage to the property, it shall be his duty to prove such damage and ZAPPYRENT will take care of the request by estimating the entity of the same, in order to establish the amount of the security deposit that the owner can retain as compensation for the damages suffered. Any decision made by ZAPPYRENT in connection with a claim shall in no way limit the legal rights of each of the parties to the other party to the rental agreement.

7 - Photographic Services

ZAPPYRENT offers the possibility to have a professional photo shoot, totally free of charge within the limits of this policy.

7.1 How to use the photographic service

In the section dedicated to the booking of the photographic service you can book your service in a totally free way. You will be asked all the information necessary to plan the photo shoot. However, due to the large number of requests that we receive daily, the waiting time to use the free photo shoot may be extended, depending on the location and the period requested. In some locations the photo shoot may not be guaranteed. In this case you will have to provide yourself to upload on the site photos of the apartment, in adequate quantities and such as to provide a clear and true idea of all the environments without omitting any defects. ZAPPYRENT, offering a high quality service, may not approve the photos you uploaded as not sufficiently detailed or of poor quality/quantity, inviting you to perform a better shooting, in the interest of all. The photos on our site that have been taken by photographers of ZAPPYRENT are the exclusive property of ZAPPYRENT, so they can not be used on other sites (even non-competing). If you violate these conditions you will have to pay the full price of the photo shooting, you will be immediately excluded from the Site and you may be liable for any damages caused to ZAPPYRENT.

8 - Dispute Resolution Center

By accepting the "Terms of Service" the parties agree that any dispute or simply any problem with the contractual counterpart, having as object exclusively the rental agreement, and not also other problems outside such agreement, such as personal or condominium relationships, shall be interpreted, settled and resolved by binding arbitration of ZAPPYRENT, without any possibility of appeal. This shall not affect the right of the parties, without prejudice to ZAPPYRENT's liability, to bring the matter before a court of competent jurisdiction at their own expense.

9 - Bookings

When a user books an accommodation through the platform, he commits himself to conclude the rental by paying a deposit equal to one month's rent (which will be deducted in the first month of rent) and which constitutes a deposit.

  • The reservation is not complete if the owner does not accept or the user does not pay the deposit mentioned above.

10 - Cancellations

10.1. Owners and Tenants are responsible for all changes to a reservation that they make through the ZAPPYRENT Platform or request ZAPPYRENT Customer Service to make ("Reservation Changes") and agree to pay any additional Listing Price, Owner Fees and Tenant Fees and/or Taxes associated with such Reservation Changes.

10.2. Under certain circumstances, ZAPPYRENT may cancel a booking request or confirmed reservation on behalf of an owner or tenant and undertake respective refunds and payments. Whenever ZAPPYRENT cancels a reservation, it will notify the parties and provide reasons for such action, unless such notice:

    • prevents or hinders the detection or prevention of fraud or other illegal activity;
    • harms the legitimate interests of other parties or third parties;
    • violates applicable laws.

11 - Cancellation Policy for Owners

11.1. If the Owner cancels a booking after accepting it, ZAPPYRENT will charge the Owner a fee equal to one month's rent of the cancelled rent. 

11.2. ZAPPYRENT reserves the right not to apply, in whole or in part, the penalties referred to in the previous paragraph, as well as the right to claim any of the above amounts if it appears necessary to apply one of the aforementioned penalties; The Owner acknowledges that ZAPPYRENT will be entitled to issue a payment order and agrees to pay these amounts to ZAPPYRENT.

12 - Cancellation Policy for Tenants

12.1. The tenant can cancel a reservation before signing the contract by contacting the customer service:  

  1. If you cancel the reservation after paying the 200 euro to make the reservation, 200 euro will be retained.
  2. If you cancel the reservation after paying the 1st monthly fee, you will be retained the 1st monthly fee (including the 200 euros).
  3. If you cancel the reservation after paying the 1st monthly payment and the Zappyrent fee, you will be retained the 1st monthly payment and the Zappyrent fee.

It is considered a cancellation by the tenant if:

    • You do not respect the deadlines given for the proposal, such as: send the documents for screening (within 2 days from sending the booking), additional document required (within 2 days from when it is requested), signing the contract (within 1 day after receiving the contract).
    • If changes are requested to your request after acceptance by the owner and the owner does not accept, such as: pet introductions, extra repairs etc.
    • If you withdraw your booking for any other personal reason.

12.2 In the event of cancellation by the tenant after the credit check confirmed by ZAPPYRENT, an amount equal to 50% of the first month's rent will be transferred to the landlord as compensation. If the cancellation by the tenant happens before the credit check and(or before the payment of the 1° month and the tenant Zappyrent fee, no refund will be paid to the landlord.

12.3 Any tenant who book accommodation on ZAPPYRENT accepts the policies of minimum period and specific early termination indicated by each owner in the lease. If the cancellation or modification of the reservation during the stay does not take place within the terms defined by the owner in the rental agreement, ZAPPYRENT will transfer the security deposit paid by the tenant to the owner as a refund for the damage suffered by them, apart from the service costs on the total value of the reservation. If the damage suffered is higher than the security deposit paid, the owner can collect these sums legally by directly citing the tenant concerned and leaving ZAPPYRENT excluded from any liability.

N.B In the case of renewal, the tenant will only have to comply with the terms of early termination.

 

13 - Refund Policy for Tenants

13.1. If an owner cancels a confirmed booking, the tenant will receive a full refund of the Total Costs of that booking. In some instances, ZAPPYRENT may allow Tenant to apply the refund to a new booking, in which case ZAPPYRENT, at Tenant's direction, will credit the amount to Tenant's next booking. In addition, ZAPPYRENT may publish an automatic review on the Listing cancelled by the owner indicating that the reservation has been cancelled.

13.2. ZAPPYRENT may determine to refund all or part of the total costs to the tenant who did not make the prior physical visit to the accommodation in the event that, within 24 hours of check-in, one of the following problems occurs:

  • the owner, even in cases where the prior visit to the Accommodation has not been made, does not provide the tenant with a reasonable possibility of access to the Accommodation (e.g., fails to provide keys and/or a security code);
  • the description or representation of the Accommodation in the Announcement is substantially inaccurate regarding:
    • the number of units in the Accommodation (e.g., number of bedrooms, bathrooms and/or kitchens or other rooms). The square meters indicated in the advertisement (where present), are to be considered indicative;
    • the type of accommodation as a whole property;
    • the lack of provision or failure to provide any of the amenities or special equipment mentioned in the description, including terraces, swimming pools, hot tubs, bathrooms (toilet, shower, tub), kitchen (sink, stove, refrigerator) and electrical, air conditioning and heating systems;
    • the physical location of the Accommodation ( neighbors);
  • at the beginning of the tenant's booking, the Accommodation:
    • is not clean and in good hygienic condition overall;
    • presents health and safety dangers that, in the opinion of ZAPPYRENT, could negatively affect the tenant's stay in the Accommodation;
    • there are animals in the Accommodation not declared in the Advertisement.

In the cases listed above, the Tenant must notify within 24 hours from check-in ZAPPYRENT, which will ask the Owner to remedy the problem as soon as possible and in any case no later than 7 days (ZAPPYRENT may require less time depending on the case). If after this period the problem is not resolved, the tenant can request a refund of the amount paid to ZAPPYRENT. If the problem is solved by the owner in the terms indicated, the tenant will not be able to request any refund if he decides not to continue the rental.

13.3. If the Tenant receives a refund in accordance with the terms set forth in the previous paragraphs, ZAPPYRENT shall be entitled to recover from the Owner the amount of such refund, including by subtracting such refund from any future Payment due to Owner.

14 - Reliability and Security

ZAPPYRENT protects the information of any nature present on the Site and/or inserted by the Users, not spreading it without their consent and protecting it with the highest existing technologies. If due to a technical failure or other nature, there should be inefficiencies, the user can communicate them to ZAPPYRENT that will immediately restore the correct functioning. ZAPPYRENT is not responsible for any malfunctioning but will always be prompt in correcting technical errors.

15 - Damage to the Accommodation, Disputes Between the Parties

15.1 As a tenant, you are responsible for leaving the Accommodation (including all movable property and other assets therein) in the condition in which it was when you arrived. You are responsible for your own acts and omissions and you are also responsible for the acts and omissions of the persons you invite to the Accommodation or to whom you otherwise provide access thereto, excluding the owner (and the individuals whom the owner invites to the Accommodation, if applicable).

15.2 In the event of damage to the Accommodation or its furniture, the conditions set out in paragraphs 5.4.1 and 6.6 shall apply.

16 - Sanctions

The terms and conditions present on the Site, including subsequent modifications, are absolutely binding for the parties who use the Services offered by ZAPPYRENT. Any violation of the Site's policies will result in penalties commensurate with the nature and extent of the violation. In principle, the gravity of the violation could imply the immediate exclusion from the Site, which could be followed, at ZAPPYRENT's discretion, by the request of the payment of the services offered free of charge, such as for example the photographic service, as well as a possible judicial action for material damages caused to the company.Users are reminded that they have the moral and legal obligation to behave according to "good faith", not only towards all the Users of the platform but also towards the ZAPPYRENT Team. Any behavior in bad faith, i.e. intended to defraud other Users and/or ZAPPYRENT will be sanctioned in the same manner as other violations.

17 - Indemnity

To the fullest extent permitted by applicable law you agree to indemnify, defend (at ZAPPYRENT's option), and hold harmless ZAPPYRENT and its respective officers, directors, employees, and agents, from and against all claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your violation of these Terms or our Policies, (ii) your inappropriate use of the ZAPPYRENT Platform or any ZAPPYRENT Service, (iii) your interaction with any Member, your sojourn at an Accommodation of the owner, your participation in a Shared Payment Service, including, without limitation, injury, loss or damage of any kind (whether compensatory, direct, incidental, consequential or otherwise) arising out of or in connection with such interaction, sojourn, participation or use, or (iv) your violation of any law, regulation or the rights of a third party. The indemnity obligation under this Section applies only if and to the extent that the claims, liabilities, damages, losses and expenses were caused by your willful or negligent violation of a contractual obligation.

18 - Zappyrent Protection

ZAPPYRENT Protection is an exclusive service of ZAPPYRENT, whose details can be consulted in the Support center, FAQ and dedicated page. The relative terms of the ZAPPYRENT Protection service are enclosed in the Management contract between ZAPPYRENT and owner.
